Vidiamo Privacy Statement

Vidiamo SAS ("Vidiamo") processes personal data. We respect your privacy and ensure that we use your personal data carefully and securely while respecting legal limitations. In this Privacy Statement, we describe who we are, how and for what purposes we process your personal data, how you can exercise your privacy rights and any information that may be of interest to you.

We have done our best to write all this information in a clear and legible manner. Nevertheless, please do not hesitate to contact us if you have any questions about the use of your personal data after reading this Privacy Statement. In addition, you will find information on how to contact us in this Privacy Statement. 

Finally, we would like to point out that the services we provide may change and therefore our Privacy Statement. Who are we?

Vidiamo is a childcare company specialising in innovation. We design and produce products that combine design with engineering and beauty with functionality. We are based in France, at 54 rue Perronet, 92200 Neuilly sur Seine.

What personal data does Vidiamo collect from you?

Vidiamo collects different kinds of personal data:

  • Personal and contact data (e.g. name, delivery and billing addresses, e-mail address, telephone number)
  • Company data (e.g. postal address, VAT number and Chamber of Commerce number)
  • Account details (for example, username and password)
  • Details of your purchases (for example, date of purchase and product type)
  • Marketing and market research preferences (for example, whether you have agreed or declined to receive our e-mail offers and/or surveys)
  • Device information (e.g. IP address, language, browser settings, time zone, screen resolution, operating system)
  • Interaction data including images (for example, when you contact our customer service department, your digital and/or written correspondence and when you download images to support your service requests)

When you purchase a product, you will also receive a request to provide your payment information. This personal data will be collected and processed directly by one of our third party payment providers. These third parties are responsible for processing your payment information to the extent permitted by law. Vidiamo does not have access to your payment information and this personal data will not be collected or processed by us. Therefore, this Privacy Statement does not apply to the above-mentioned information processing activities. For more information on how your payment data is collected and used, we refer to the Privacy Statements on the websites of our partner Paypal.

We receive the types of personal data described above directly from you.

Personal data received directly from you

For example:

  • Personal data you submit when you create an account and/or register a product and/or other information you enter or provide when using our website
  • The personal data you provide when purchasing a product
  • Personal data provided by the way you browse our website
  • Personal data provided when you complete our form during an event
  • Personal data provided in (among other things) service requests, correspondence, comments, help (Q&A), dispute resolution, etc., are not disclosed to third parties.

Personal data you send about other people

You may share personal information about other people with us. For example, their address and contact information when you enter another delivery address when you finalize the order. We point out that it is your responsibility to check whether these people approve of sharing their personal data with Vidiamo. 

Personal data we receive from third parties

We may receive (among other things) additional personal information, for example with the help of social networks or third party services, insofar as permitted by law. In particular, the law may require you to give your prior consent.

When you communicate or interact with or about us on social networks (for example, by posting a message, uploading a multimedia file, or clicking the "Like" button), we (or third parties acting on our behalf) may collect personal information about you (information that is present in your public profile such as your (user) name, profile picture, gender, age range, country, etc.). We do not store this information. We use it to increase our presence on these social networks and to identify the interests and preferences of our (future) customers.

Why does Vidiamo process your personal data?

Vidiamo collects and processes your personal data for the execution of the purchase contract(s) concluded with you, administration, services, communication and marketing (personalized or not) and fraud investigations, for quality and management reasons as well as to meet legal obligations.

What is the legal basis for the processing of your personal data by Vidiamo?

The processing of personal data is legal only when it is based on one of the legal grounds listed in the exhaustive list. Vidiamo relies on three of these legal grounds. We process your data because of a contract and/or because Vidiamo has a legitimate interest in your data or because you have given us your consent.

Execution of a contract. We use your personal data to carry out the necessary preliminary steps for the conclusion of a contract and to execute any contract concluded with you.

Legitimate interest. We also use your personal data for Vidiamo's legitimate interests. You will find more information about Vidiamo's legitimate interests in the following sections.

Consent. Your consent allows us to use your personal data for marketing purposes and/or to assist us in our market research. You can always withdraw your consent. To find out how to do this, please see the section "Can you withdraw your consent at a later date? ».

What are Vidiamo's legitimate interests that make the processing of your data legal?

Vidiamo needs to process your personal data to create and maintain a lasting relationship with its customers, to monitor and improve its products, services and processes and to protect the interests of the company. For example, to inform our customers about new products, services and activities, to request customer feedback on our products, to prevent security issues and abuse of our applications or to protect Vidiamo's interests in (possible) legal proceedings.

To the extent possible, we will use and apply the so-called "opt-out system" to our communications. This way, you can easily let us know when you no longer wish to receive communications from Vidiamo. You can of course always contact us directly by e-mail at info@vidiamo.com.

To whom does Vidiamo send your personal data?

Vidiamo may transmit your personal data to third parties under the terms of this Privacy Statement to the extent permitted by law. Vidiamo will not transmit your data to third parties for personal marketing purposes without your explicit consent.

Your personal data may be transmitted to the following categories of recipients:

The authorities. For example, supervisory authorities, tax and customs authorities, police and other legal bodies. We may pass on your personal data to :

  • Comply with a legal obligation or court order; or
  • If necessary to prevent, trace or prosecute criminal acts; or
  • If necessary to strengthen our policies or protect the rights and freedoms of others.

Business service companies. We use third parties to provide our services. For example, a transportation company mandated by Vidiamo to deliver the product you purchased, or an online payment provider mandated by Vidiamo to manage online payments. In addition, we engage third parties such as analytics companies, advertising agencies and social networks to analyze data relating to your use of the website, to perform any website and communications customizations, and to display relevant offers and advertisements.

Others. Any third party to whom we pass on your personal data with your consent (for example, in the context of collaboration), and/or of which Vidiamo is now or will become part in the future in the event of a restructuring, merger or acquisition.  

Insofar as these third parties process your data, they do so as a processor for Vidiamo. Vidiamo has taken the necessary steps to ensure that your data is used exclusively for the above-mentioned purposes. 

How do we protect your data?

We have adopted both technical and organizational measures to protect your data against loss, theft and unauthorized access. We are constantly improving our security measures in response to technological advances and developments. We also recommend that you properly secure your own passwords and electronic data carriers.

Are your personal data transferred outside the EU?

Where necessary, your personal data is transferred and/or processed outside the European Union. Vidiamo has taken all necessary measures to ensure that transfers are only made within the limits provided by law.

All European countries are governed by the same set of legal provisions. This body of law is intended to ensure a consistent level of protection when processing personal data within the European Union.

Vidiamo is allowed to (legally) transfer your personal data to countries based on the so-called "compliance decision". A compliance decision is a decision taken by the European Commission that requires the country in question to guarantee a sufficient level of protection for personal data.

The (legal) transfer of personal data to other countries will only be carried out once the adequate security devices provided by Vidiamo have been installed.

How long does Vidiamo store your personal data?

Your personal data will be removed and/or made anonymous when it is no longer necessary for the purposes for which it is processed. In addition, we can assure you that Vidiamo will not store your personal data longer than permitted by law. 

How can you manage your personal data?

You have the right to know whether or not your personal data is processed by Vidiamo and, if so, to request access to an overview of your personal data, a correction and/or deletion. In addition, you can also restrict the processing of your personal data, object to the processing and you have the right of data portability. Below you can read where and how you can invoke all these rights.

If you have your own Vidiamo account, you have access to some of your personal data that we store. You can correct or delete this data at any time.

Can you withdraw your consent?

If you have given your consent for a specific processing activity of your personal data, you can withdraw it at any time. As a reminder, withdrawal has no retrospective effect and is only possible if you have given your consent in advance.

Can you file a complaint?

You can file a complaint with the French Data Protection Authority regarding the use of your personal data by Vidiamo. For example, if you believe that Vidiamo is not using your personal data carefully, or if you have requested access to or correction of your personal data but are not satisfied with our response.

Are you obliged to give us your personal data and what are the consequences if you do not?

In some cases, Vidiamo needs your personal data. For example, to enter into an agreement with you, to provide a service or to create an account. Information fields that are not marked with an * do not require you to enter your personal data.

When your personal data is required, it will be marked with a *. If you decide not to provide the required personal data, we will not be able to conclude an agreement or provide the service in question. By transmitting the personal data required in the information fields that are not marked with an *, you give your consent for Vidiamo to process this data.

Does Vidiamo use profiling techniques?

We would like to contact you in a personal and relevant way. To make this possible, we collect, combine and analyze your personal data to determine the most appropriate target groups, segments, content, advertisements, information, times and channels, and to limit contact requests.

For the purpose of creating profiles, the following personal data may be grouped, analysed or segmented in various combinations:

  • Demographic data: this is not personal data but, for example, data related to the region. When demographic data is associated with an individual, it may become personal.
  • Transaction Data: Personal data from a transaction between Vidiamo and you.
  • Interaction Data: Personal data from communications between you and Vidiamo. For example, the items you have ordered or registered, the service requests created, the type of browser used, the type of device you have and other cookie identifiers. Offline interactions are also included.
  • Behavioural data: personal data relating to your behaviour and processed by Vidiamo such as your preferences, opinions, wishes and needs. We may collect this data, for example, by tracking your behaviour on our website or your link to a social network account. We collect and process information using tracking cookies only with your consent.
